Terms and Conditions
- When we mention Seller, we mean Mr Przemysław Barcikowski ith its registered office in Klaudyn 05-080 Krzyżanowskiego 47 Street, Poland. NIP: 1182025910; Regon: 364086005
- Customer - an individual, legal entity, or organizational unit that is not a legal person but to which special regulations grant legal capacity, who makes an Order from the Store;
- the Civil Code - the law of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
- Terms and Conditions - these Terms and Conditions for the provision of electronic services offered in the online store available at https://www.minimaker.com/,
- Online store (Store) – Online store available at https://www.minimaker.com/, through which the Customer may place Orders;
- Goods - products presented and offered in the Online Store, visualization of the finished 3D resin print.
- Contract of sale - a contract of sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Customer, concluded with the use of the store's website consisting of an order by the customer of an individual 3D resin print.
- The Law on Consumer Rights - the Law of May 30, 2014 on Consumer Rights (Journal of Laws of 2014, item 827);
- The Act on Provision of Electronic Services - the Act of July 18, 2002 on Provision of Electronic Services (Journal of Laws No. 144, item 1204 as amended);
- Order - the Customer's request to buy any Goods from us.
- Account - Customer's account created online in the Store, based on provided personal information to access facilitate a contract of sales and protected by password.
II. Acknowledgement
2.1 These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Seller.
2.2 These Terms and Conditions are the rules and regulations referred to in Article 8 of the Law on Provision of Electronic Services.
2.3 These Terms set forth, in particular:
(a) rules for registration and use of an account within the online store;
b) terms and conditions for making electronic reservations of products available in the online store;
c) terms and conditions for placing Electronic Orders in the online store;
d) the principles of concluding Sales Contracts using the services provided as part of the Online Store.
2.5 In order for Customers to use our Store without interruptions, we recommend the following minimum system requirements:
(a) Internet Explorer version 9 or later, or
b) Firefox version 21 or later, or
c) Chrome version 29 or later, or
d) Opera version 12 or later, or
(e) Safari version 4 or later, or
(f) a minimum screen resolution of 300 x 700 pixels.
2.6 In order to use the online store, the Customer needs an access to the internet on a suitable device.
2.7 Customers may access these Terms and Conditions at any time through the link provided on website of https://www.minimaker.com/ where it is also available for download and printing.
2.8. Information about the Goods provided in the Store, their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, as defined by Article 71 of the Civil Code.
III. Terms of using the Online Store
3.1. The use of the Online Store, including making purchases, is voluntary.
3.2 An Account is set up by completing and submitting the registration form.
3.3 In order for a Customer to create an Account it is necessary to agree to the Terms and Conditions and provide personal data required by fields marked as mandatory.
3.4. The Seller may refuse the right of Customer to use the Online Store, as well as may restrict the Customer's access to part or all of the Online Store's resources, with immediate effect, if the Customer violates the Terms and Conditions, and in particular if the Customer:
a) provided untrue, inaccurate or outdated, misleading or violating the rights of third parties information during Account registration,
b) has committed, through the online store, a violation of the personal rights of third parties, in particular the personal rights of other customers of the online store,
c) commits other behavior that will be considered by the Seller as inconsistent with applicable laws or general rules of Internet use or detrimental to the good name of the Seller.
3.5 In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store shall take technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.
3.6 In particular, the Customer shall:
a) not to provide or share content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,
b) use the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices,
c) not to take actions such as sending or posting unsolicited commercial information (spam) within the Internet Store,
d) use any content posted within the Online Store only for their own personal use,
e) use the Online Store in a manner consistent with the provisions of the laws in force in the Republic of Poland, the provisions of the Terms and Conditions, as well as with the general principles of Internet use.

IV. Placing Orders for Products
4.1 Customers can place orders directly on the website https://www.minimaker.com/ by selecting the Goods and adding them to the shopping cart, taking subsequent actions based on the prompts and messages displayed on the screen.
4.2 You can customize your order in the Cart page before confirming it. Modifications include selection of Goods and their quantity. In order to do so, follow the instructions displayed and the information available on the site.
4.3 Once you provide all the necessary data, a summary of the submitted Order will be displayed. The summary of the submitted Order will include information such as:
(a) selected items,
b) the unit and total price of the ordered products or services, including delivery costs,
c) the selected method of payment,
d) the selected method of delivery,

4.4 In order to submit an Order it is necessary to accept the Terms and Conditions, provide required personal data and click the button titled "Order with obligation to pay".
4.5 Once the Order is submitted, it constitutes a declaration of will to conclude a Sales Contract with the Seller, in accordance with the content of the T&Cs.
4.6 After placing an Order, the Customer shall receive an e-mail message titled Shop minimaker.com - Confirmation of Order No., containing the order summary and confirmation.
4.7 The cost of shipping is proportionally divided among the purchased products on the invoice issued for the order and in a summary of the order sent per email.
4.8 The Contract shall be considered concluded at the moment of receipt by the Customer of the e-mail message referred to above.
4.9 The Contract of sale shall be concluded in English or Polish language, with the content in accordance with the T&Cs.

V. Delivery
5.1 We can only deliver to the address provided when placing order.
5.2 We use courier service for delivery. Delivery costs depend on the total value of the order and the destination. Details of shipping costs is available at https://minimaker.com/en/delivery.html In addition, the delivery costs will be indicated at the time of placing the Order.

VI. Warranty claims on delivery
When accepting the shipment from the Courier, you are obliged to:
6.1. Carefully inspect the Goods and check whether the package is crushed, damaged, wet or has been opened,
6.2. Seller recommends opening the parcel before signing it off in the presence of Courier and inspect its content, in accordance with art. 545 par. 2 of the Civil Code:
If the sold thing is sent to its destination through the carrier, the buyer is obliged to examine the consignment at the time and in the manner usual for consignments of this type; if he found that during transport there was a loss or damage to the thing, he is obliged to do all things necessary to determine the liability of the carrier.
If you notice any discrepancy or if your Goods arrived damaged, it is necessary that you:
6.4 Record on the consignment note objections to the shipment,
6.4. write down a Damage Protocol in the presence of the courier (no later than the next day after delivery),
6.4. contact us via email - office@minimaker.com – the same day and provide relevant information about the damage or any other issue and attach relevant photo that will support your claim and serve as documentation.

VII. Prices and payment methods
7.1 Prices of Goods are quoted in Polish Zloty (PLN), Euros (EUR), British Pounds (GBP) and US Dollars (USD) and include VAT.
7.2 Your order may be a subject to import duties and taxes (including GST), which are calculated after the shipment reaches the destination country. Additional import charges are the liability on Customer’s side.
7.3 The following are the available payment options:
VIII.Loyalty Points Terms & Conditions
- Each customer will be awarded 2 points for each euro spent. (points accrued within 24 hours of paying for the order).
- The system automatically saves and updates points based on the transaction value.
- Collecting points starts with the first purchase.
- Every product in the store can be bought using accumulated points instead of money.
- The price of the product in points is shown on the product page.
- A product can be bought with points by clicking the link ”Buy for X pts” displayed on the product page below its price.
- A product can be bought either entirely with points, or entirely with money.
- Loyalty points cannot be exchanged for cash.
- Points cannot be exchanged for the purchase of gift cards.
- You will not receive points for any item you pay for with points.
- If you decide to return the purchased product, the points will be forfeited.
- Points will be earned on every purchase - except for restricted items.
- Products may be excluded at the Seller's discretion or by operation of law.
- Every Client participates and cannot exclude themselves from the Program.
- Loyalty points do not expire.
- Your points remain until you use them or close your account.
IX. Right of withdrawal from the contract
The right of withdrawal is regulated in Article 38 of the Consumer Rights Act (hereinafter: the Act). Pursuant to Article 38(3) of the Act, the right of withdrawal from a contract concluded off-premises or at a distance is not granted to a consumer with respect to contracts in which the object of performance is an item that is not prefabricated, manufactured to the consumer's specifications or intended to meet the consumer's individualized needs.
Article 16(c) of Directive 2011/83/EU prohibits national legislation from establishing a consumer's right of withdrawal from a contract providing for the delivery of goods manufactured to the consumer's specifications or clearly individualized.

X. Refund and complaints policy
9.1 The Seller shall be liable to the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code under the warranty for defects to the extent specified in the Civil Code, in particular Article 556 and Article 556[1] - 556[3] of the Civil Code.
9.2 Complaints, resulting from violation of the Customer's rights guaranteed by law or under these Terms and Conditions, written details should be sent by e-mail to: reklamacje@minimaker.com
You should include:
a.) Your details and details of the complaint
b.) Photos of the advertised product showing the described defect
c.) Your demands.
The Seller will investigate all complaints within 14 days, or where this is not possible, Seller will issue explaining and advise when a substantive response will be made to you.
9.3 You have the opportunity to use the out-of-court method of processing complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection in Warsaw. Information on how to access the aforementioned dispute resolution mode and procedures, can be found at the following address: www.uokik.gov.pl, under the "Consumer Dispute Resolution" tab.
9.4 At http://ec.europa.eu/consumers/odr, consumers have access to resolve consumer disputes electronically through the EU online platform (ODR platform). The ODR platform is a multilingual, interactive website for serving consumers and businesses seeking out-of-court settlement of disputes arising from the conclusion of a distance sales or service contract.
XI. Final provisions
10.1 Settlement of any disputes arising between the Seller and the Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Civil Procedure Code.
10.2 In matters not covered by these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on Electronic Service Provision and other relevant provisions of Polish law shall apply.
